The city's Child and Family Services Agency, "just didn't do their job." They're still not.

CFSA social worker Kerstin Rae Magnuson reported that she found "no concerns regarding the immediate safety and well-being" of the little girl. And documents obtained from her mother's attorney under the Freedom of Information Act show that CFSA employees falsely informed Children's National Medical Center in a May 29, 2009, letter that the investigation had been requested by the child's noncustodial mother.

Case in point: The city has repeatedly been warned about the worsening condition of a 7-year-old girl who suffers from severe chronic neutropenia, an extremely rare failure of the immune system that leaves her highly vulnerable to ordinary infections. But the little girl is not being treated for this life-threatening condition, even though she is one of only 1,300 people worldwide to be listed on the Severe Chronic Neutropenia International Registry.
Because of her dual German/American citizenship, the German Embassy has been the only governmental body willing to intervene on behalf of this seriously ill child to date. That's an embarrassing indictment of the District of Columbia............................

3. In a justice system that heavily relies on the integrity of police, prosecutors and judges, the re-appointment of Judges Michael J. Cassidy and Dennis Smith (Fairfax County) who

colluded (or conspired) with the Commonwealth’s Attorney’s Office for Fairfax County to cover up serious crimes on the part of the Fairfax County police officer and the Assistant Commonwealth’s Attorney will send a terrifying message that official lawlessness may be above the law.

Accordingly, I request that the certifications of Judges Michael J. Cassidy and Dennis Smith be

temporarily withheld pending more complete investigation.

4. On December 10, 2010, I testified about two inextricably-intertwined proceedings:

one before Judge Cassidy of the General District Court(Cases Nos. GT08258169-00 and

GT08258170-00 ), and one before a series of judges of the Fairfax County Circuit Court (Cases

Nos. MI 2009-321 and MI 2009-322). I contended that serious crimes have been committed, and

that the evidence backing my claims of judge shopping, false swearing, fabrication of “evidence,”

perjured testimony (over and again), subornation of perjury and cover-up thereof is ironclad and

well-documented. The only thing that was not clear was whether anyone in the Virginia Legislature

or otherwise in authority will have the nerve to pursue a matter in which Fairfax County judges,

prosecuting attorney(s) and a police officer are the ones being accused of committing felonies. The

individuals in question have engaged in conduct prejudicial to the effective and expeditious

administration of the business of the court by manipulating established court procedures so as to

accomplish their personally desired result(s). Moreover, a criminal justice system in which the

prosecutor alone is able to select the judge of his choice to preside at trial so that this judge will be

his agent or henchman (as it is the case here) raises serious concerns about the appearance of

partiality and serious questions about the confidence in the judicial integrity of our courts and the

obvious prejudice that such actions have on the public confidence in the judiciary.

5. My claims of judge shopping, false swearing, fabrication of “evidence,” perjured

testimony (over and again), subornation of perjury and cover-up were reduced by Delegates Janis,

Athey and Gilbert to discretionary rulings regarding “facts” and “no judge shopping” in order to

deflect the attention from the true issues that have nothing to do with either any “facts” or unfettered judicial discretion. While a court has jurisdiction and discretion to err and the remedy to correct an error by a trial court is to appeal the court's decision upon entry of a final order, no trial court has jurisdiction to render the order based on an invalid indictment (or warrant or summons) -such orders

This was not the first time that violations of defendants' due process rights in Arlington's JDR Court have been reported. In September, attorney
Roy Morris petitioned President Obama, Secretary of State Hillary Clinton and Attorney General Eric Holder to intervene on behalf of Ariel King, who not only lost custody of her then 5-year-old daughter but was barred from any future contact with her seriously ill child even though King, like O'Brien, was not an Arlington resident.`

Another anomaly: Roy Morris received two slightly different final court orders, both dated June 6, 2008, and both signed by Judge Esther Wiggins Lyles.

That same day, court transcripts show, Judge Wiggins Lyles forced a woman who had not been subpoenaed as a witness to testify on the stand without benefit of the legal representation she clearly requested. A federal investigation into such violations of due process rights should be next.

Arlington officials ignore jurisdiction
as the grandmother's "history of instability in housing, employment and poor judgment ... [and] a history of legal problems including check fraud that is currently under investigation by Montgomery County."
But the girl and her granddaughter were living in Stafford County at the time, not Arlington. And their "home state" as defined by the Virginia statute was Maryland, not Virginia.
Arlington social workers obliquely acknowledged their lack of jurisdiction when they took the child to Chevy Chase on Aug. 31 and used her state of Maryland "Healthy Smiles" Medicaid card and her former Bethesda address to get the girl's teeth cleaned, X-rays taken and two small cavities filled. But jurisdiction wasn't the only legal requirement Arlington decided to ignore.
In a five-page rebuttal filed with the Juvenile and Domestic Relations Court, Delores Heffernan- O'Brien testified that she had never been served with the 2009 removal order, and only saw it for the first time on July 26, 2010 -- four days after her granddaughter was taken into foster care.
As a result, she could not defend herself against any of the charges against her in an apparent violation of her constitutional due process rights.
Then it happened again. "I never received written notice of the most important hearing of my life," O'Brien, a Mormon, former model and widow of a prosecutor, said of the Aug. 19 hearing she missed as a result.
Arlington JDR Chief Judge George Varoutsos found her guilty of neglect and abuse in absentia, and suspended her one-hour-per-week visitation with the child she had raised from infancy. The only contact she was allowed was a once-a-week phone call monitored by the foster parents so
Yet just two days later, she says, her granddaughter's court-appointed guardian ad litem allowed the same Montgomery County detective investigating check-kiting charges against her (which have since been dropped) to interrogate her granddaughter until she became hysterical.
Calls to the guardian ad litem, the Arlington commonwealth's attorney's office, and the social worker involved were not returned.

Judgeswield enormous power, but that power is not absolute. They are duty-bound to obey legal rules that protect defendants' constitutional rights. One of those rules is jurisdiction, loosely defined as the court's authority to hear the cases before it. On July 22, Arlington County social workers took a 10-year-old girl away from her 64-year-old grandmother and placed her in foster care based on a Feb. 19, 2009, emergency court order that cited "allegations of neglect" as wellO'Brien would not upset her granddaughter with her "adult" problems.

Ladies and Gentlemen of the Virginia General Assembly, Judge Esther Wiggins-Lyle is a danger to innocent families in Northern Virginia.
Why? Judge Lyle has put the well-being of children second to the interests of people like lawyers with money and political influence.

Because of Judge Wiggins-Lyle, my daughter Sabrina and I will never be able to see each other until after she turns 18. She is five years old now, and my husband and I have not been allowed to see her for the last two and a half years.

My baby girl Sabrina lost about 10 ounces after birth, within the 6 to 10 per cent weight loss that is NORMAL for a newborn. As a first time mother, I expressed concerned to my doctor, who admitted me with my baby to Arlington Hospital. In 5 days at the hospital, my baby gained 11 ounces, then at home with me, gained 12 ounces in 4 days, before Judge Lyle accepted the false statement of Arlington CPS that I was "starving the baby".

Judge Wiggins-Lyle signed an Emergency Removal Order, presented to her by Arlington Child Protective Services without allowing my husband, myself or any legal counsel to be present to challenge the removal order.

Judge Lyle then placed Sabrina in the custody of an assistant federal prosecutor for the Department of Justice and his wife.

Arlington CPS leveled a charge of the highest level of child neglect against us. This charge, however, was later overturned upon appeal to a hearings officer in Richmond, who stated that CPS lacked evidence for this charge.

Nevertheless, the series of court trials we went through with Wiggins-Lyle to try to regain custody of our child were always rigged against us. She showed favoritism toward Sabrina's foster parents, allowing them to show her photos they had taken of Sabrina, but not allowing Kit and I to do the same. She had no objection to the fact that early on, the foster parents were referring to themselves as “Mommy” and “Daddy” to Sabrina, or to the fact that they presented her with a videotape they made of Sabrina, in which they bragged that they would show the video to Sabrina on her wedding day.

When Arlington CPS alleged that I suffered from a learning disability and a form of autism that presented me with challenges in interpreting non-verbal cues from an infant, Judge Wiggins-Lyle did nothing to compel the agency to comply with the American with Disabilities Act by providing me with services to help parents with disabilities.

Throughout our year-long series of hearings before Judge Wiggins-Lyle, she acted in an unprofessional manner. For example, she would always allow witnesses for Arlington County to go on the stand first, whereas our own witnesses would be put on last, thus causing them to have to charge us more money for their time in court. In some cases, she would swear one of our witnesses in, then leave her on the stand for a long time before being interviewed while she casually discussed procedural issues with County prosecutor Mary Craig.

Judge Wiggins-Lyle was continually rude to myself throughout the hearings as well. On one instance, she accused me of “lacking maternal instinct”. At another hearing, she asked my to respond to charges made against me by CPS. I stated that I loved my daughter, and wanted her returned to me. In response to this, Judge Wiggins-Lyle rudely said to me “Well, this isn't about what you want, it's about what's best for Sabrina”. On another occasion, she asked my lawyer “what makes you think that Sabrina should be returned to Kit and Nancy’.

Should a judge like Esther Wiggins-Lyle, who has shown a clear bias against the birth parents of children be allowed to continue to make rulings from the bench that will tear apart yet more loving families? I say no, she should not be reappointed.

Last year, before the same legislative panel, veteran attorney Roy Morris blasted then Chief Judge Wiggins Lyles’ handling of a custody case in which she completely terminated a mother’s contact with her five-year-old daughter. “I’ve never seen a worst run court in all my years of [litigation] experience,” Morris told legislators on Dec. 21, 2009. “My client was dragged into the Virginia court even though Virginia didn’t have jurisdiction… Why would a judge have taken a case that they didn’t even have jurisdiction to hear?”

How best do we move beyond personal adversity to create social transformation?

Radio Show Brief: Unfortunately in the rush to improve society from its baseness the sanctity and sacredness of life has been left unattended to. Much to the irony of western liberal democracy, the most vulnerable in society i.e. – women and children are ill affected. In the midst of soul wrenching adversity and life draining circumstances individuals worldwide have risen above their personal anguish and given momentum to social justice movements and campaigns which seek to provide hope, justice and quality of life to all who are or may suffer their similar losses, challenges and personal pain.

It is noteworthy to say that some of the great resolute from pain to hope for all stands have been nurtured by those who nature has endowed with that life sacred maternal instinct – women, oftentimes mothers. Social hope from anguish and despair has been energised historically by names or groups like Harriet Tubman, Ida B Wells, the Suffragettes, Rosa Parks, Winnie Mandela, Mothers against Violence, Doreen Lawrenceand many others. Each story has been one of anguish, personal triumph and social advancement. Each story’s evolution has provided a basis for stages of progressive social change for others in society.

The ongoing campaign for the right to medical care for the critically ill, Little Ambassador, Ariana-Leilani, by Dr Ariel King has provided yet another source of a saga of anguish which is providing an oasis of hope for all children globally. The irony of the continual noncooperation by either the national bodies of both the USA and Germany and the young daughter’s own father to allow Ariana-Leilani to receive life enhancing medical attention defies belief. This is markedly strange when both countries are both bastions of western liberal democracy and have endured brutal histories of the threat or abuse of the sacredness of human life.

Prior to and during the above developments Ariana-Leilani’s mother, Dr King has organised tirelessly to raise both public awareness, seek restitution and change and provide social structures internationally which would work to prevent any child to go through what boils down to a blatant regards for the rights of the child. Her two foundations,Ariana-Leilani Foundation International and Ariel Foundation International are sterling models of the evolving a legacy of the potential of hope and just change from the anguish of personal life’s challenges.

This is the kind of work we need to do in Virginia to get activist judges out. Virginia's method of having Bar Association members select a Judge from among their own buddies is a clear conflict of interest and should be done with.

In 2005 & 2006, I objected to the former Bar President Janine Saxe being elected as a Judge. Janine Saxe had earned a name as a "White collar Child Abuser" for her abusive tactics of creating litigation in family courts and profiting from it.

While being the Seceratry and president of the Fairfax Bar - She was instrumental in nominating several Judge including Judge Langhorne Keith who was an openly radical Judge opposed by Rob Whitfield, Ron Fisher and others of FathersForVirginia. She was also among the people involved in getting Judge Gaylord Finch kicked upstairs from JDR to Circuit Court and three years later got herself a JDR judge position.

Two mothers had brought a lawsuit against Janine Saxe and took it all the way to the Supreme court before loosing out. The attached flyer was what we distributed to the Bar, Elected officials and others.... But guess what..The incoming Bar President and Fairfax Bar Association nominated her for JDR Judge position and got her elected in 2006. She is currently a Fairfax JDR Judge...

Iowans made a clean sweep of the state Supreme Court on Tuesday, voting to recall all three justices who were up for a retention election. The rout is being played as an unprecedented politicization of state courts. Maybe if judges behaved less like politicians, they'd have less reason to fear recall votes.

Voters were expressing their dismay over a 2009 Iowa court ruling that gave the green light to same-sex marriage. That unanimous decision, which overturned a state law defining marriage as between a man and a woman, struck voters as an attempt by the seven justices to impose their views on the state. This is precisely the kind of judicial arrogance—finding a right to gay marriage in the state constitution after many decades in which no one noticed it—that the recall election was designed for.

To choose its judges, Iowa employs a version of the so-called Missouri plan, whereby a state judicial nominating commission submits two or three names to the Governor from which he may choose a new judge. Once on the bench, judges face retention elections after the first year and then every eight years to remain on the court.

In Iowa and most other states that run similar methods of judicial selection, retention elections are typically pro-forma. Judges run unopposed, and voters are rarely motivated to shake up state courts. Nationally, some 99% of judges win their retention elections, and Tuesday's triple ouster was the first jettisoning of Supreme Court justices since Iowa adopted the current system in 1962.

That's just the way the liberals like it, allowing the lawyers guild that dominates the nominating process to get virtual lifetime tenure for their selections. According to the Des Moines Register, Iowa's nominating commission includes 12 Democrats, one Republican and one member whose affiliation is unknown. Critics of the judicial ouster naturally deplored the recalls as a "misuse of the judicial retention vote."

But Iowa's voters aren't yahoos who recall judges willy-nilly, and when judges exceed their writ in such blatant fashion they shouldn't expect an automatic pass from the people whose lives are governed by their decisions. Perhaps sensing that their ouster had exposed the flaws of the process that elevated them, the three ex-justices issued a statement expressing their "hope" that "Iowans will continue to support Iowa's merit selection system for appointing judges."

We hope not. To fill the three vacancies, the state's nominating commission must now select candidates—either rushing them through the lame-duck office of departing Governor Chet Culver or leaving the choice to Republican Governor-elect Terry Branstad. That process is sure to be closely watched by Iowans whose votes against the last bunch were meant to send a message to the "non-partisan" commission picking judges. A better system would be to let the Governor nominate anyone he chooses and have the legislature offer advice and consent, as in Washington.

Groups like the George Soros-funded Justice at Stake have poured money into convincing voters that they should let committees pick their judges, but disenchantment with the system is growing. Voters in Nevada on Tuesday rejected a ballot measure that would have moved the state to a Missouri-style system, while retention elections in Colorado and Kansas were more hotly contested than usual.

Far from a beacon of judicial independence, the three Iowa justices were fired because they put their own political preferences above their commitment to the law. If judges want to avoid recalls, they should leave social legislation to legislators.

Who is Barry Goldstein? He is a lawyer, writer, speaker, and activist. He was practicing in New York for Genia Shockome in the Family Court until the Judge through the book at him for speaking the truth. Barry didn't let this faze him. If a judge through a book at him, then Barry would write a book, or at least co-write and co-edit a BIG BLUE BOOK (710 pages) with Mo Hannah, founder and director of the annual Battered Mothers Custody Conference held in Albany, NY. This book may revolutionize the Family Courts. Barry is a regular invaluable speaker and teacher at the BMCC. This book, Domestic Violence, Abuse, and Child Custody: Legal Strategies and Policy Issues, ISBN: 1-887554-76-9 goes for a whopping $139.95, but it well worth it, as 25 seasoned advocates and professionals contribute a chapter each (see 2nd article below for details).

Barry has an unusual voice, someone once described it as underwater baritone, his content is right on, as his speech is streamlined for efficiency and impact. He has a New York accent, whatever that means, and he is very amiable and helpful. Barry was recently at the October 1st and 2nd event in Washington D.C. On the first day, he marched with the troops from the Department of Justice to the Senate buildings, where he and the top organizers, the "A Team" as we called it, because they talked with the key Senatorial Aides. On both days, Barry could be seen holding one end of the banner, while munching on apples from a thoughtful Mom who also blessed us with delicious scones... I digress a bit.

The point I am trying to make is that Barry was on the front lines of activism. So, I am sure there is more that Attorney Barry Goldstein has done for women and children over the years, and there is still more he will do. I encourage all of you to attend the 8th BMCC on January 7, 8, and 9, 2010. The focus and title of the conference is UNITY. Barry is one of us who exemplifies this goal.

One more of too many Fairfax County Courts Horror stories

The more I read the more these situations mirror my own.
This situation is particular mirrors the court experiences I have been having this past 18 months in Fairfax, Virginia. The GAL is so biased and proud of it too!
He informs me that he speaks to the father’s attorney and has never responded to me once.
Also, my son would sit next to his dad and allow him to lie to the therapist while in session. I would look right at my son and he would not move a muscle to correct the situation, Many times my son said,”What am I going to say while in court mommy because the odds are I am going to be put back in his home.”!! Well, the judge did depose my teenager in his chambers and he informed him how much he wants to return to me and that it would be best in all areas of which are considered under the law to Modify Custody. Well, to make a long story short after his father and attorney manipulated the custody trial through various means, the judge after repeatedly saying i as going to be granted custody but after school finishes, did not do as he stated.
After all of the abuse the father has been accused of doing to this child and the judge repeatedly saying he is going to give me custody goes and Denies me my Motion! What he did is denied me my Due Process Rights and should be taken off of the bench!
So his dad goes and abandons him a week later in the Virginia courts where they live and pressed assault charges on our son. The court places him in Foster care where he has been severely neglected and assaulted. They did not even want to enroll him into public school when he is a gifted child! No medical care has been provided as well. The only one that has been providing him with stuff and taking care of him is :”me”.
I still have supervised visitation and you are so correct in saying that “they” hate it when there is actually no problem or things improving. My psych assessment came back excellent and they could not stand it! They said they have to discuss this with the therapist etc etc and never did! It was all lame excuses.
What a mess and the sad part is that the children are being so severely damaged. The damage will not even be apparent until they grow older and start to realize the relationship they were denied with their loving mom and the years they cannot make up!
This is so sad that a court that is suppose to protect is hurting and is the problem!Reading these articles helps to make my situation so much more clear because I have been all alone throughout this domestic abuse for 26 years! Now, my X has involved our son who is now 16. The abuser will wait until the child is old enough to manipulate but not old enough to rebel and be independent!
The truth speaks for itself. For so many woman who never shared stories to all have such similar if not identical experiences!

Everything I have seen is backdoor dealings and rulings made on the spot with no investigation or real oversight as to the impact of those rulings on people's lives.
I am a mother in Charlottesville, VA. I have been in the Charlottesville
JRD courts over custody of my children for 16 years.

As far as i have
witnessed the idea of "justice" is a mockery in the VA JDR courts.
I might have gotten a more unbiased decision if I had asked a random person
on the street what their opinion was.

List of the Judges who are up for reappointment in this coming year and who will be evaluated during the coming legislative session.

I would suggest that if you know of any of the judges on the list who are exemplary, write a letter of support with specific information as to why you support the reappointment for those particular individuals.

Likewise, if you know of any of those on list who should NOT be reappointed, and with whom you have specific complaints against that individual or individuals, take the time to construct a thoughtful letter of “No Support” or “Complaint” and send it to the same organizations

I would suggest you send those letters to the chairman of both the House and House Senate Courts of Justice Committees as well as the Judicial Inquiry & Review Commission.

Judge David Debenham’s first order of business on Friday was to clear the courtroom of witnesses to the proceedings. He claimed it was in the best interest of the child. Then, he confiscated Ms. Dombrowski’s cell phone, ordered the records sealed, and issued a gag order. This is from the court docket:

Rights for Mothers Invitation
On Mother’s Day 2010, a large crowd of well over 100 concerned citizens wearing Mothers of Lost Children white T-shirts rallied in front of the White House. After a silent vigil from 11:00 am until noon and a speakout from noon to 1:00 pm that included Mildred Mohammad, former wife of the D.C. Sniper, there was a march down 17th Avenue. Our signs and banners protested the family courts endangerment of 58,000 children per year who must visit or live with their batterers and molesters with no hope of release.

The event was so well received that we will meet again on Friday, October 1st, 2010, the first day of Domestic Violence Awareness Month, in front of the U.S. Department of Justice, 950 Pennsylvania Avenue NW, Washington, DC 20530-0001 for a press conference at 11:00 am (pending permits).
We will then march about a mile to the Senate buildings and attend prearranged visits with Senators to request that they reschedule the 1994 the Senate Labor and Human Resources Subcommittee Congressional hearing that was postponed. That hearing was designed to address the issues of failures of child protective and family court systems to protect adult and child victims of violence and abuse, statutes of limitations for reporting sexual abuse, and retaliatory targeting of mandated reporters who report child sexual abuse. These problems have grown significantly worse in the past 16 years.
We will end our march at the Sewall Belmont House, 144 Constitution Avenue NE, the suffragists’ headquarters a century ago.
We plan to stay at the Hostelling International, 1009 11th Street NW, Washington DC, which we found to be clean and inexpensive. The following day, Saturday, October 2nd, we will rally at 1600 Pennsylvania Avenue in front of the White House.

When children witness domestic violence, they start to believe it is acceptable. The Department of Justice has stated they don’t even have to witness it…they just have to be in the same household to be considered as witnessing. When an abuser gets custody of children from their victim, the children get validation, thanks to family court and the associated corrupt bastards, that it is acceptable to beat a parent, then take the children to live with the perpetrator. So this study is no surprise given the sad shape of family courts worldwide, and the bias against mothers.

Its sad to hear that this woman is not the only one I am having problems with another Guardian Ad Litem Named Nancy Alsfeder , who works on cases coming out of fairfax county who is not doing her job and trying to do her best to see that my daughter goes into the system. I am a fit father who resides in california and has been traveling back and forth .This Nancy lady has nothing to put against me but the fact that I have lived a great satisfying life in a different state ...My daughters mother who has been allegated with abuse and neglect against my daughter and who is facing assult and battery againt her own motherand also has drug dependency problems, is still being given a better oppurtunity than I have they are still some what considering my daughter be put there with her..But ultimately placing her in foster care there is no reason for my daughter to be awarded to the state when she has a father who can provide and nurture her..It sad that this county is getting away with destroying familys Please if there is anyone who is interested in hearing my case or have some advice on what i can do please contact me.

I am learning that my story is all too familiar. My divorce case was heard in Suffolk, Virginia (3 hours southwest of Fairfax). I have lived in Northern VA for a little over two years now, since my ex-husband threw me and our 20 month old son at the time out of our home. He pulled a knife on me and locked himself in the bathroom. He kept yelling that he wished he was dead and wished he had a gun. When I tried to leave with our son in my arms, he swung open the door and tried to pull our son from my arms into the bathroom with the knife. During the first hearing two years ago, I was awarded full custody and he got supervised visitation. He was also ordered to go to a psychiatrist for an evaluation, which he turned out to be diagnosed with Major Depression and Adjustment Disorder. A Guardian ad Litem, T. Kirk Pretlow was assigned to the case at the request of my husband's attorney. My attorney objected, requesting the judge appoint his own, but the judge turned the request down. From that point on and for two years, the GAL was a nightmare for me. He never called me, interviewed me. or even called my son's daycare and doctor for interviews. He kept threatening me to "talk" to my husband or it would result in me losing custody. I replied to him (through email) that I had no problems talking to my husband, but only about our son. My husband wanted to talk to me everyday, and cried to the GAL whenever I didn't citing that I was not communicating. To make matters worse, my husband assaulted my mom during a visitation drop off and was convicted in August 2008. THe GAL told me that it was my fault for the assault, even though I wasn't even there. He always blamed me for my husband's outbursts. I reported the GAL to the Virginia Sate Board in November 2008 and wrote a letter to the judge. By rule, they notify the attorney when a complaint is filed. I was hoping this would get him to remove himself from the case, make the judge remove him or at least make him do his job, but it did not. He said that my son should stay with me, but during the final trial on August 31, 2009, he stood up and saif that he "changed his mind." He said that I needed to "mellow out" and I needed to have my son taken away from me to teach me a lesson and make me talk to my husband. The judge had said earlier in the case that he would wait for the GAL's opinion before making a ruling on custody. The parenting evaluator also changed his mind. His first report recommended that I keep physical custody, with my son not spending more than a week from me. Well, in February 2009, he was paid double by my husband to conduct a new evaluation and had already conducted a home visit before even calling me to tell me. His name is Dr. Brain K. Wald. In court, he admitted to being paid $6000 by my husband and $1000 for his appearance. He even lied about when he spoke to me. I lost physical custody of my son to a man with mental illness and an arrest record. I would ask myself how o why this happened, but I know how, and only the good Lord knows why. I believe that this is a temporary situation to allow me to reach out to others and share my story. Shedding light on our judicial system is the only way there wil ltruly be justice. THere are so many corrupt attorneys and judges out there, that to try a remove them all on your own would take forever. But to bring the stories together and shed the light on the bigger issue; children being displaced and losing precious years for no resason. If you want to share you story, you have a pair of ears ready to listen. I plan to write an editorial to publish of the many stories out there that are all too familiar and devasting.

Listen to the report Three parents have filed complaints with the Sacramento Police Department against Doctor Janelle Burrill who is a court-appointed mediator in custody disputes in divorce cases. Among those on the losing end is Jayraj Nair. He says his son was taken away in handcuffs a year and a half ago and that he and his entire family have been barred from seeing his son since. He says Doctor Burrill diagnosed Suraj as suffering from Parental Alienation Syndrome after the boy did not want to visit with his mother. Burrill's attorney and husband, John O'Donnell would not comment. In March, her Board Certified Diplomate Certification was revoked by the American Board of Examiners.

I truly hope the system can come crumbling down and we can pull our children from the wreckage.

"When a protective mother who is not trained in the law…tries to get criminal charges filed against a child abuser and speaks out when the system failsher child, she is prosecuted."We have seen repeated examples" he says, where officials "have neglected their duty to aggressively and competently investigate child abuse cases and take offenders off the street."

She said that the Children’s Assessment Center, a Houston-run facility that specializes in assessing children who may have been abused, confirmed that her daughter had been molested and sexually assaulted by her husband. On top of it, her husband had voluntarily confessed to police that he had, indeed, molested children.
But weeks had since passed and her now-estranged husband had still not been arrested.
In a television interview with the 11 News Defenders, the mother described how the police officer handling her case had repeatedly promised an arrest on a particular date. But she claimed that date would come and go with no arrest.
Frustrated, she said she called the officer and was told that it wasn’t unusual in "these types of cases" for an arrest not to occur until nine weeks had passed.
Eventually, the mother decided to tape her next conversation with that officer, which was later broadcast on KHOU.
In the taped exchange, he explained the delay:
" I’ve got 100 of these that I’m actually working on literally...and there’s no way you can work ‘em with any kind of consistency and keep up."

Another lazy, biased, corrupt judge lets an abuser have visitation with young son he is abusing, and threatens to take custody from the mother if she complains anymore about it. Judges that do this deserve the death penalty.
Fire them, send them to court and convict them, and sentence them to death. That is what they do to these children when they tell mothers they are lying, and order the children to go with the abusive father.

“Your honor, I fear for my son, he came back with all the bruising,” Gallegos said, according to court transcripts, not finishing her sentence.

“I already made my order OK?” Pacheco said. “I talked to the detective; the detective talked to the doctor. I’ve done my investigation, I feel very confident this man did not hurt his son all right? …“I think you’re overreacting all right? Now, if you continue to act this way… I’ll have to take custody away from you and… I will give custody to the person (Murderer of your little Son) that is most willing to cooperate with the other parent, and giving them custody OK?” Pacheco said, according to court transcripts.

“I understand you want to protect your child, and that’s fine. That’s the way moms are, and dads too. But I don’t see anything here to stop him from letting him see his son OK?

I really don’t.”

Pacheco ordered the mother to continue allowing overnight weekend visits between the toddler and his father and threatened to take away custody if she made additional allegations against the father.

Child custody evaluators should know how to differentiate between types of violence – because a one-size-fits-all approach to custody can endanger both mums and kids, according to new American research.
The University of Illinois study reveals that evaluator’s beliefs generally fall into two categories, and one group is far more likely to prioritise safety for women and children when making custody decisions.
“Some evaluators see conflict as a natural part of relationships. When domestic violence occurs, they reason that it takes two to tango. When a couple’s relationship is over, these evaluators see no reason the mom and dad can’t co-parent safely, especially if they’ve both attended court-ordered anger management classes,” said Jennifer Hardesty, a U of I associate professor of human and community development.
“The other group believes that anger management classes work for some couples, but they also know that violence can be used to control and terrorize women, and that children may be used as pawns in the relationship or as weapons against the mother. In such cases, these evaluators carefully craft custody arrangements that will keep the mother and children safe,” said doctoral student Megan Haselschwerdt who worked with Hardesty on the study.
The researchers would like to see standardized and mandated training that would teach custody evaluators how to discriminate between types of violence because different kinds of violence require different interventions.
“Unfortunately, many courts are applying a one-size-fits-all model to custody cases. It’s important to err on the side of safety. Safety precautions can be relaxed if it turns out that there’s not as much of a risk as was thought. That’s better than just assuming that there’s no risk,” Haselschwerdt said.
In the study, 23 custody evaluators participated in in-depth interviews, answering open-ended questions about their beliefs and how they made decisions.
Members of the “it takes two to tango” school said that most of their cases involved situational violence or arguments that turned physical because couples were unable to manage their conflicts properly-for example, a heated conflict about finances that ended with a shove.
These custody evaluators acknowledged that extreme cases of battering exist but said they almost never saw them.
But Hardesty disagrees.
She said: “These evaluators described situations that clearly went beyond situational violence, but they were convinced that was all they were seeing.
“In fact, speaking up for her safety can backfire on a woman if an evaluator decides she is trying to alienate the father from his children by making exaggerated claims. The evaluator may then compensate by prioritizing the father’s custody rights.”
The more prevalent type of domestic violence is situational violence, which probably occurs in approximately 60 percent of the evaluators’ cases.
In at least another 30 percent of cases, described by scholars as intimate terrorism, one partner attempts to control the other through threats of violence and a willingness to follow up on them.
“Usually there are multiple forms of control-not allowing the partner to make any financial decisions, threatening to take the children away if the abuser’s demands aren’t met, emotional abuse, name calling, degrading or humiliating the other person-anything that would terrorize someone or make them feel less human,” Haselschwerdt said.
“Attempts to control could involve keeping a log of how far a partner has driven or checking their cell phone and where they’re going on the Internet. These sorts of monitoring behaviours become dangerous when they’re followed up with threats of violence,” she said.
Hardesty added: “There are many models and templates for suggested ways to do these evaluations. They tell evaluators what kind of information they need, how many people they should talk to, and how much time they should devote to an evaluation, but there are no legal requirements for how they should actually be done.”

He became mentally and verbally abusive and nothing I ever did was good enough. Going behind me and cleaning even after I had done a fine job of it before. I felt he was OCD. If the wife-beater is a danger to his (ex)wife, then, he is a danger to her children. One does not need to have a law degree to know this. Family courts are powerful, secret societies. Wife-beating cases belong under the jurisdiction of a criminal court, and not the farce and fraud of a family court. If judicial immunity is not ended, then, the family court judges will keep-on breaking the law.

The family courts should be open to the public, to the press/media and to court watchdog organizations, especially in secret courts the deal with children, that have done away with court reporters and the evidence. If judges like Judge Bruce D. White of Fairfax County , Virginia were actually to consider what is the best interest for children, they wouldn’t be taken from their mothers and handed to fathers who seek sole custody (a typical request of abusive fathers, as found by the American Psychological Association’s Presidential Task Force Study on Violence in the Family), especially when mom had been the primary caregiver all along.

All these father’s groups are screaming about “fatherlessness” and our government is giving all these father’s groups BILLIONS of our tax dollars to promote “responsible fatherhood,” i.e. help fathers fight for custody in court. Don’t laugh…it happens.

Actually, the studies show that children (either sex) are at more risk with single fathers than they are with single mothers.

One statement in this study stood out to me, because it was particularly true in my situation…and I am sure others moms: “single mothers devoted a greater share of their household food expenditures to grains, vegetables, fruit, and milk, whereas single fathers spent more on food away from home and on alcohol.” Just one statement picked out of a 20 page report, but it rings so true.

Imagine the scenario. You are sitting as a substitute judge and a prosecutor slams a code book down while making a dramatic point in a drunk-driving case. Do you fine her? What if some guy is hot under the collar about a traffic ticket and wants to use the courtroom as a forum to tell off the cop in public. What do you do?

Judging is full of lightning-speed judgments, often with tremendous consequences. That’s why Alexandria General District Court Chief Judge Becky Moore created the Substitute Judges Academy, inviting top lawyers from across the commonwealth to the city courthouse on King Street.

Described by one speaker as the "farm team" of candidates for future seats on the bench, participants swapped horror stories from the courtroom, learned about new laws that go into effect July 1 and sung Happy Birthday to the undisputed legal dean of Alexandria, Judge Daniel Fairfax O’Flaherty.

"Substitute judges with judicial education are better prepared to serve well in court," said Moore, who hosted the first substitute judges academy back in January. "I think it’s important to have as much judicial education for the substitute judges as possible."Lesson one: Learn the law. And starting this week, there are a whole lot of new ones. It’s part of the annual ritual in Virginia, when the actions of the General Assembly session earlier in the year becomes the law of the land.

Starting this week, sending spam e-mail messages is a crime and community centers are now considered gang-free school zones.

One of the more challenging new laws for the courts to consider is a new code section that outlaws sending obscene text messages."I think that one is probably unconstitutional," said attorney David Oblon, whose law partners include House Majority Leader Moran Griffith (R-8) and House Courts of Justice Chairman David Albo (R-42).

Oblon spoke to the institute about the raft of new laws, touring a legal landscape that included everything from the sublime to the ridiculous. Wearing a mask during the commission of a felony is now a crime, although cold weather is not one of the considerations that should be taken into account. People can carry concealed weapon into bars, although they are not allowed to drink while packing heat. Then there’s a host of new exemptions that Oblon called "exemption creep," including allowing people with suspended licenses to drive to church and adding the death penalty for those who kill a fire marshal and auxiliary police officers."This is death-penalty creep because every other group is going to step forward and say they deserve the exemption," said Oblon. "I would expect to see more of this in the future."SOMETIMES SPLIT-SECOND judicial decision-making can have drastic consequences for years and decades to come. Attorney Jim Clark recalled a routine marijuana case where the defendant wanted to waive counsel. He figured a night or two in jail was the path of least resistance, but Clark warned the pinch-hitting courthouse gang to consider the bigger picture."Gee, maybe I don’t have to tell my parents," Clark recalled the defendant explaining. "That can come back to haunt people 10 years later."Sometimes, judges make the wrong decision. This is what happed several years ago in Alexandria, when a teacher was killed after a protective order was denied. Commonwealth’s Attorney S. Randolph Sengel told the institute participants that nobody wants to see their name in a headline as the judge who released a defendant on bond before he commits a murder."The most serious cases are the easiest to figure out. The more difficult cases are not as serious ones, like petty larceny or trespass," said the elected prosecutor. "I think a healthy dose of common sense carries the day."Moore spoke to the institute about ethics in the courtroom, presenting a series of situations that the group is likely to consider while wearing the robe. Human nature being what it is, Moore said, Virginia’s courtrooms are full of boorish behavior and short-tempered litigants. many women in Fairfax, myself included, somewhat broken and beaten down, can testify to feeling crushed in a tantamount manner, financially and spiritually, by judges who'd rather make quota than focus on doing their best in deciding a case.

Instead of reducing library hours and cutting school funding to save money, perhaps the judicial budget should be explored for savings and salaries reduced or tied into performance as rated by the taxpayers until the purpose of the courthouse is restored.

After trying for over a year, I finally, and quite unexpectedly, was granted an Order to Show Cause by the Chief Judge of the Circuit Court in Fairfax County against my ex husband for contempt. The issues involved would sound familiar to any divorced woman - tardy (or non-payment of) alimony (or child support), failure (twice) to keep current home or work information as required by the Final Decree, and in my case, a failure to sell the marital residence within 120 days of that document. The hearing was set for May 21st; I dutifully prepared and filed a Memorandum in support of my position.
On the appointed day, I drew Judge Bruce D. White. He was running late from the 10AM (law) docket session; by the time our case, scheduled for 11:30AM, and his last one for the day, was called, it was 1PM. I was given 15 minutes to present my fairly complicated argument, which contained infractions spanning over six years, and examine two witnesses. - (Fred Rejali) An impossible task. And needless to say, the Judge's decision was that I had not proven my case. Duh! How could I? I had barely scratched the surface when he called "time up!"
Leaving out the details of my ex's long pauses in "answering" my questions as a tactic in stalling and taking up time, or his attorney's resorting to, as his primary tactic, an attempt to soil my good name to "balance" things out, because, well, that's all he had, as I was sitting in the courtroom all I could think of was why was something as important as the issue of late (or non-payment) of alimony (or child support), relegated to so little judicial concern and attention?
There is something very wrong with a system that does not honor the provisions of its own orders, by way of allowing a litigant - and in most instances, still, a female one - to fully present a case for contravention and consequential damages. It begs the question, what good are judicial dictates, if, when someone does not abide by them, a complainant is held to such an impossible and nebulous standard that the resultant message from a judge is "who cares?" As a follow up corollary, then, just what good are courts?
Fifteen minutes is not enough time to prove a case that is far from simple. But what I found even more baffling is that during my hearing, not once did Judge White admonish my ex for his flagrant, longstanding and extensive violations of the Final Decree. I would like to think that this is not a "men stick together" thing, but the absence of a scolding, on a contempt Order issued by the Chief Judge, was glaring and disappointing.
The better course on issues such as violations severe enough to merit a Rule to Show Cause would be to routinely schedule the matter on a day other than Friday Motion Day, allow at least an hour, and let each side to present all their evidence before making a decision, which might even be taken under advisement. Otherwise, why bother issuing the Order to Show Cause in the first place, except to go through the motions, no pun intended, and cruelly leave the injured party in no better position than before. It would also be helpful if the judge came prepared and was familiar with the file; in my case, the silence in response to my query as to whether my Memorandum had been read spoke volumes.
A decision is only as good as the system that generates it. Some of that has to do with personnel; most of it with institutional procedures. It all equals bad judging, and from my perspective, it appears that women, particularly those that cannot afford high priced representation, those that need the court's assistance the most, are more often than not on the receiving end of its shafting.

The legal concerns of citizens paying the tab deserve quality handling, not the bum rush herding treatment that so many of us are familiar with in another broken system - health care. And while premature physical infirmities and death are a more obvious byproduct of a sick mode of operation, many women in Fairfax, myself included, somewhat broken and beaten down, can testify to feeling crushed in a tantamount manner, financially and spiritually, by judges who'd rather make quota than focus on doing their best in deciding a case.

While campaigning, Bob McDonnell's "one new idea" was divestiture of the state liquor stores. Now, schools, social services, public safety, and state employee pensions are on the commonwealth's GPS. Virginia is for S's. Why not shift gears? Backpedal closer to the top of the alphabet, rather than fuel taxes and gun sales, and privatize the courts. Portions of their functions already are privatized -- for example, through the increased use of mediation. In many instances, a judge's signature is just a rubber-stamp of an out-of-court compromise or one party's position. With more legal issues being resolved the DIY way, there is less need for the traditional role of the judiciary, or for the pricey courthouses that garage them.
Or they could become self-funded, or the "public option" in a hybrid system, forced to upgrade the quality of their product to maintain traffic on the theory no one will pay for a lousy, accelerated job. This would mean parking the best, most experienced personnel in the lower courts, where decision-making is typically determinative. If litigants are satisfied below, such positioning could eliminate the need for some of the vast appellate bureaucracy -- more potential budget savings. Because here's the clunker we have now: There's the "avoidance canon," where judges either don't decide or rule on a ground which really doesn't resolve anything, but disposes of a matter to get it off their desk. Expensive and inconclusive for litigants who expect and deserve more than a drive on the road to nowhere.
Another major problem, at all levels, is law-clerk justice. Just out of school, a bunch of mostly 25-year-olds in training, making impactful decisions that their bosses blindly sign off on. As these rulings travel up the system, they are routinely rubber-stamped by more apprentices, who cover their peers' tracks in this self-interest network where everyone's paving the way for their next career move. A stop sign should be put to this extra-constitutional exercise of judicial power and payment of redundant salaries.
In a Virginia running on fumes, officials need to look past their blind spots to non-retread solutions. That includes the commonwealth's side street and back alley courts. It's as easy as A, B, See . . .

I had sole custody of the children (ages 13 & 16) since birth, they were both on honor roll and living well. The law was clearly ignored, despite the mountain of evidence presented at trial. I was given total decision making over education and therapeutic needs - basically, am required to babysit the dad and report back to court each time that he harasses the school -- so that I can be harassed again. Weekend visitation only. How do you start the process. So far my written complaints have been ignored. "

The judge who gave my ex husband custody of my two kids was later found to be on heroine & other illegal drugs, & used it quite regularly while doing his job.

He slept through most of the trial the day I lost my kids in 1998. (signs of heroine use) I got a recording of this trial because I wanted to prove that he slept through it, unfortunately the courts conveniantly cut out the part of him snoozing in the court video. And I didn't get 5 & a half hours of trial recording either, I think I was lucky to get 1 hour of the recording after they were done editing it.

There were reports that Judge Ray Harding Jr. was very abusive to his wife & children. He was sent to prison, for idk how long. But I was never able to get a retrial, no attorney I hired, dared to do it. And to this day, the 4th district court in Provo, Utah has nothing bad to say about Judge Ray Harding Jr. The heroine addict....> > I feel these Judges NEED to be held accountable for the decisions they make that destroy ppl's lives... It makes me sick to see the consequences of the rulings they make, after blatently ignoring evidence of abuse or threats made. Their decisions have effected too many children to count. Makes me wonder how they would feel if they got letters from some of these poor kids after they age out of the system, telling them how they destroyed their lives?... Good Afternoon,

My name is Lisa Parenti and I live in Midlothian, VA. My daughters were taken away from me on July 23, 2009. at the time my oldest daughter just turned 5 and my youngest was 10 months old.

I started dating my husband in September of 2001. The relationship was very rocky, but in July 2003 I found out I was pregnant with my first child. After I told him I was pregnant he packed up and moved to West Virginia with his dad. In October 2003, he contacted me and stated that he wanted to work things out and he wanted me to move to West Virginia, so I did in hopes that we could work things out and my child wold have a family. In March 2004 my daughter was born, in August 2004 we moved back to Virginia. The very next day he left us. He did not pay child support nor did he return until she was 2 years old. At that time he once again wanted to work things out and I went back to him and a month later we got married. in May 2007 i noticed a change in his behavior, he became increasingly verbally abusive, threatning, volitile and distructive. Often trowing furniture at me, calling me a "worthless piece of shit", and telling me " Do you have any idea how much easier my life would be if you were dead" He also started drinking heavily. In April 2008, I discovered that he was having an affair with our daughter's friends mother. After I found out his drinking and his behavior became even worse. On June 1, 2008, 6 months pregnant with my second child (whom he openly denied was his until she was 3 months old), I took my daughter and left him and went back to live with my parents. In August 2008 I deneid him visitation due to him constantly threatning me over the phone that he was gonna kill me. In September 2008 shortly before the birth of my second child I filed divorce papers. Scott D. Landry Esq. was appointed Guardian ad Litem in my case and, after lengthy trials and litigation from September 2008 through July 2008 of he and his mother stating that I abuse and neglect my children, which couldn't be further from the truth, and making him out to be the victim. he was awarded full physical custody of my children.

I see my girls once a week on Wednsdays from 6pm until 9am and every other weekend from Friday at 6pm until Monday at 9am. I am not allowed to be apart of my oldests education, or do any extra activities with my children. And 95% of my monthly salary goes to him for child support. He doesnt work and has a full time nanny at the house to take care of the children.

I am completley heartbroken. I went from being their primary caregiver (he did absolutley nothing for them or with them) to only having a limited amout of time with them while a nanny raises them.

we have come across the little known fact that James P. Toscano, Esq., the General Counsel (top lawyers) for DC Child Protective Services (CFSA) has an arrest record in Arlington, Virginia for indecent exposure (masturbating in a urinal in a public bathroom (frequented by children) while looking into a bathroom stall) at a shopping Mall.

When a Child Protection Executive Employee is a sex offender, likelywith minors involved, should they remain in the public's trust and continue to work, especially when they use their influence to help suspected abusers to not be detected and accountable?

This arrest occurred 2004 when Mr. Toscano was an attorney recently transferred to Child Protective Services (CFSA) from the DC Attorney General’s office.

He was charged, and through his attorney who specializes in "park arrests" with sexual activity made a deal with the Arlington County Prosecutor that the charges would be dropped after he finishes a year of supervised probation and complete a sex offender evaluation.

After the one year probation, in 2005, the charges were dropped just before his scheduled trial.

Despite this arrest and the nature of the charges, Mr. James Toscano who works alongside the Director, Dr. Roque Gerald as an Executive who sets policy for all, and an employee arrest policy that states automatic termination, he is allowed to continue working at DC Child Protection Agency (CFSA) on children’s abuse cases. In addition, he was promoted in 2008 to the General Counsel of CFSA.

A 2007 memo of the then CFSA General Counsel stated that a Probation before Judgement (PBJ) for indecent exposure is grounds for termination — but Mr. Toscano was not terminated. As explained in the letter to Mr. Wells and Dr Gerald, Mr. Toscano has helped the suspected abuser by personally interfering and providing false information in at least one case helping to cause the investigation to be improperly done. Mr. Toscano actively worked to help the alleged abuser/neglectful parent and appeared to act beholden to the abuser’s attorney (who is from an old Arlington family and knows his way around its courthouse very well — and no doubt knew about Mr. Toscano’s background). In 2009 and 2010, Roy Morris, Esq. testified before the DC City Council Chair, Tommy Wells Committee regarding this matter twice, and in neither instance was there any followup or expression of concern from any DC officials.

They act as if they know all of this already, and are intent on doing nothing about it.The problem here is too obvious, based on the documentation attached.

Any family court judge who grants custody of children to a wife-beater, should be charged with child endangerment. If the wife-beater is a danger to his (ex)wife, then, he is a danger to her children. One does not need to have a law degree to know this. Family courts are powerful, secret societies. Wife-beating cases belong under the jurisdiction of a criminal court, and not the farce and fraud of a family court. If judicial immunity is not ended, then, the family court judges will keep-on breaking the law. The family courts should be open to the public, to the press/media and to court watchdog organizations, especially in secret courts the deal with children, that have done away with court reporters and the evidence. The taxpayers are supporting these courts, so the public and the public's elected representatives should have access to the family court records, at any time and without delay, in the public interest and in the children's interest, to weed out corruption and negligence and to ensure that that the taxpayer's dollars are not being squandered.

Battered mothers often shy away from publicity. But this year, in a sign of their growing organization, some plan to spend Mother's Day in Washington in a White House vigil to draw attention to a court system that often gives custody to abusers.

(WOMENSENEWS)--On Mother's Day, busloads of battered moms and advocates for abused children will roll into Washington, D.C.

They'll hold a vigil outside the White House in an effort to persuade President Obama to take up their cause of reforming a family court system that they say all too often puts children into the hands of abusive parents.

For some it marks a new and somewhat frightening degree of public exposure. Some of the protesters will be shrouded in scarves, hiding from their abusers or a court system they fear will punish them for speaking out.

"They're whistleblowers," said vigil organizer Connie Valentine, policy director for The California Protective Custody Association, based in Sacramento. "The system doesn't look kindly on whistleblowers. It's a difficult situation because we have seen enormous judicial retaliation against mothers who step up in front of the problem."

Efforts to quantify the problem are just beginning but protective parents claim it is widespread. A study done by the Williamsburg, Va.-based American Judges Foundation in the early 1990s showed that in 70 percent of challenged cases, battering parents involved in custody battles persuaded authorities the victimized parent was unfit for sole custody, according to a spokesperson from the foundation.

Valentine and other advocates for protective parents call the family courts broken and corrupt and say the system not only puts children into the hands of abusive parents, it also bankrupts and punishes the protective parents who fight for them. At the same time, they say it's hard to reform the system because the people it hurts are hiding from abusers and anxious to avoid publicity.

Shifting Ground
But Valentine feels the ground shifting. "I think we're in the early stages of a civil rights movement for protecting children from physical and sexual abuse."

She said the Internet is helping battered mothers come together. "E-mail has helped. It's a good part of the reason for all of the advocacy," Valentine said. "Women are beginning to see that it's not their fault and that they are just pawns in the game."

Mo Hannah, psychology professor at Siena College, near Albany, N.Y., used the Internet to organize the first annual conference for battered women seeking custody in 2004, after her own difficult custody battle.

This past January marked the seventh gathering, which meets annually in Albany and is the major organizing and networking event of the year for protective parents.

"The first conference was about getting people to talk and validate their experiences," Hannah said. "But as the conferences continued it became very clear that we needed a national movement. Now the conference is just sort of an umbrella or structure that encourages people to share with each other."

Over the seven years, women have met at the conference and formed smaller groups, such as the Massachusetts Protective Mothers for Custodial Justice.

"Mass Moms," as it has come to be known, brings together women who have gone through custody battles with those currently in the throes. Volunteers accompany women to court and on lawyer visits and play a general shepherding role.

"We stand next to a woman who is fighting for her children while she pleads and receives orders," one Mass Mom told Women's eNews at January's Battered Mothers Custody Conference.

These volunteers have all been through their own custody battles and declined to be named for fear of retribution from their ex-husbands or the court system. Many have gag orders associated with their own cases. It is this type of fear of retribution that has helped keep the protective parents movement under the radar.
Fear Stands in the Way
The California Protective Custody Association's Valentine understands the fear that keeps women from protesting and fighting the bigger battles.

"I waited until my own children were grown so we weren't affected by the family court system," she said.

Valentine says advocates and organizers need to study and replicate the successful civil rights campaigns of the past.

"Slavery was ended with a good law but slavery wasn't ended because a good law happened to come about. The law happened because huge masses of people put their lives on the line and fought for it," Valentine said.

This year "Mass Moms" is preparing to add some more public activism to their advocacy with a demonstration taking place in Boston on a date to be announced soon. In what they're planning to call "Confetti," the moms will symbolically shred court-appointed guardian reports--which they feel are particularly unfair to protective parents--into little bits and toss them at the statehouse to call attention to the plight of protective mothers fighting for custody of their children.

In New York City, a group called V.O.W., or Voices of Women, has been working within the court system to try to provide legal counsel and one-on-one help for women. On a wider scale its mission is to "promote long-term systemic change by documenting institutional failures, testifying at hearings, creating position papers and meeting with local and state officials."

Both Valentine and Hannah say this is the right time to take the movement to the next level.

"The new president is a fatherless man with a good wife and they will hear us," said Valentine. "And if they don't hear us, Vice President Joe Biden worked on the violence against women act and he will hear us. And if they don't hear us we will keep going until they do hear us."

In Virginia, my ex-husband called child services claiming I was harming my kids. They came to my house and..............

he had told the social worker, Tara Jorgenson, how he had gotten the bruises.None of this was ever documented They told my sons if they ever told me that I would go to Jail forever.

I want to start with telling you that the experiences of me and my children have made us strong. I know this is the ending but I feel it should be read first before the rest of the story. The unfairness that was executed on us does not hurt us anymore. I have 4 wonderful boys who have good grades, attend college and hold down jobs. They have loving relationships with me and my husband, each other, friends, and girlfriends. Now to start at the beginning of our nightmare.

The night my life fell apart. I had been working the swing shift as an industrial hydraulic mechanic. I went to pick my children up from my sister’s house and there was not an answer at the door. I then found myself surrounded by the Layton Utah police. They frisked me, and then asked me why I was there. I told them I was there to pick up my children. I was told to go home and there would be papers on the door explaining what was going on. I found documents stating my children had been taken into emergency custody.

A few days later we had the shelter hearing. I was accused of abusing my sons. I was accused of having gender identity issues since I was a mechanic. I was accused of using drugs. They kept asking me how my son had gotten some horizontal line bruises on his back. I did not know. I kept telling them this. A few months later I was told I could have my kids back if I admitted to abuse and went to counseling and went to parenting classes. I did this and regained my children back. A couple of months later I was accused of sexual abuse when my son fell off of a school toy, hitting his private area extremely hard causing him to bleed. They almost removed my children from me even though the accident happened at school! They could not find any evidence of abuse so they did not remove my children from my home but they did fondle and had over 5 people look at my son naked supposedly for a physical.

The next month they went to my son’s school and removed them from my home again. In the mean time I had gone to civil court and had charges dismissed against me for child abuse. I went thru all the crap for a second time and when I finished the court case and it was closed I left Utah that day with my children. By this time my credit was in the toilet because I was paying attorney after attorney in a fight to get my children back. I was using money that was to pay bills to pay attorneys. I lost my jobs. I am a service connected disabled veteran and it became even more difficult for me to gain employment. I did not know why. Until I applied to be a census worker this year and they said I had lied on my application about not having any convictions. I then requested a copy of my background check, and there in black and white it said I was guilty of child abuse. I ordered court transcripts and the judge dismissed the case, but someone put it in the system as a guilty verdict. This has prevented me from getting some high paying stable jobs unfairly. I lost a position at Chase, Beneficial, Countrywide and Wells Fargo. I had found a more appropriate job for a female and had gone to work in the banking industry; however they had prevented me from gaining employment to take care of my kids.

In Virginia, my ex-husband called child services claiming I was harming my kids. They came to my house and said what they found is not what had been described to them from the people in Utah. I then agreed to a New Horizons in Home Study. After the 10 hours per week in home study, observing me and my children I have not had any more interactions from the Children’s Services. I know they have been called by my ex-husband but due to the in-home observance they do not have a need to come back.

Last year my son, who is now a successful college student and working adult, told me that he had told the social worker, Tara Jorgenson, how he had gotten the bruises. Apparently my sisters step son was yelling at my kids to clean the house. So my son had gotten a bottle of Windex and was dusting and cleaning the TV. He was picked up and threw against the entertainment center. Rather than face me and tell me what had happened to my child my sister had taken my boys to the police station and told them she did not know where I was or how to get a hold of me. My second son who is turning 18 in a few weeks and will be starting college in September told me that he told the social workers and police the same story that the oldest son had told. None of this was ever disclosed to me. None of this was ever documented as them telling them how the bruises happened. They told my sons if they ever told me that I would go to Jail forever.

They told my kids that when the prosecutor asked them if I feed them that he was asking if I ever cooked dinner from scratch. Food that came from the freezer or out of a can did not count. They told them that the prosecutors were not talking about sandwiches, hotdogs or macaroni and cheese. I was supposed to grow vegetables for them and make homemade food for them. That I was a bad mother for feeding them already prepared food and canned vegetables. They told my boys when the prosecutor asked them if I took care of them he was really asking if they had a dad in their house to help take care of them. They filled my kids with lies and brainwashed them for court. They told my sons not to bath or brush their teeth while they were living in the children’s shelter. Then when they were placed in the foster homes they were out of practice of self care. When my sons were taken they had A’s in school. The Children’s services had report cards from a school my kids did not even attend to enter into court saying I did not go to parent conferences. My kids attended Edison Elementary; the report card is from Gramercy Elementary (where they attended while in state custody)! My son was returned back to me after my ex-husband broke his collar bone because he refused to take medication.

I have the documentation which shows the courts mistake on my record. I can fax these or scan them and email them. I will sign waivers for you to obtain documents from dcfs and the new horizon home study. My sons will be willing to testify or sign notarized documents as to what was said to them and by them in state custody. My sons will sign documents about the abuse that took place without my knowledge and that they had disclosed this not only to social workers but also to police. I will be in attendance at your rally in DC at the White House. I live in the DC area if there is any more I can do to help your cause please let me know.

Officials of the "Commonwealth of Virginia" can robb, steal, kidnap and kill with impunity, and often do so.............

People often say that it is impossible that Virginia State Officials committed crimes by kidnapping my daughter, because then they would be sued.

What they don't understand is that Virginia is the only state among the 50 states which has not waived its own sovereign immunity. This means that a Virginia state official can rob, steal, kidnap or even kill you, and will not face any trouble for this, as long as he is acting in his "official capacity".

The Eleventh Amendment to the Constitution of the United States gives each individual state immunity from suit by citizens of other states.
Since then, and especially in the aftermath of the American Civil War, 49 of the 50 states have waived their own sovereign immunity. This means that, for example, if you get hit by a truck driven by an employee of New York State, you can sue the state for injuries.
However, if that truck was driven by an employee of the Commonwealth of Virginia, the Commonwealth is immune from suit, especially if the truck driver did not hit you by accident but rather ran you down with intent to kill you.
Because of being shielded from any sort of prosecution, Virginias officials know that they can commit criminal acts and therefore often do so. The court and judicial system of Virginia shields them from any sort of prosecution.
It is for this reason that Virginia officials have even been so bold as to venture into other states, kidnap children and bring them to Virginia. The parents of the kidnapped children never get them back.
If the child on her own runs away and escapes to another state, as Sara Wilson did a few weeks ago, Virginia officials then invoke the full faith and credit clause of the Constitution and the interstate compact and have the child extradited back, even though the child has no family members in Virginia. (Sara Wilson is still hiding out in Queens and has eluded capture thus far.)
When they kidnap children from other countries, as they did in the case of my daughter, Virginia officials have the best of all possible worlds, because they do not represent a country and therefore do not have to obey international law, and yet they are shielded by sovereign immunity from being prosecuted under US law as well.
Virginia even elected a known cocaine dealer, Charles Robb, to the United States Senate.
Here is a story about people who have been killed by corrupt Virginia State officials, and their families have no recourse: Virginia Psychiatric System Investigated. In it, an official of the "Commonwealth" which kidnapped my daughter from Abu Dhabi says: "We don't want the feds continuing to come into Virginia and tell us how to run our facilities''.

My concern now is for Arlington Virginia, because I think Wiggins poses a risk to local families and children.

I think that all of us who have been done wrong by Judge Easther Wiggins;Lyle have a right to expose her, and also to publicize the names of other people, such as CPS social workers, who have used her to steal our children from us.

If she had listened to me, my daughter would not have been abandoned
by her father for all those years.

The Court failed to give appropriate consideration to and grant custody of Sabrina to her relatives, specifically Christopher Slitor and her maternal grandmother, Louise Hey. It was established by a preponderance of the evidence that Christopher Slitor or Louise Hey were willing and qualified to receive and care for Sabrina; were willing to have a positive, continuous relationship with Sabrina; were committed to providing a permanent, suitable home for Sabrina; and, were willing and had the ability to protect Sabrina from abuse and neglect. Further, the preponderance of the evidence established that Louise Hey would submit herself to any terms and conditions which would promote Sabrina’s interest and welfare. The Department’s failure to follow through with its affirmative duty and to meet its burden of proof to investigate all reasonable options for placement of Sabrina with relatives, specifically the Department’s failure to explore many identified potential relative placements other than Louise Hey.

Chairman Wells, and Members of the Committee, my name is Roy Morris, and I
am here as a public interest advocate. Today I urge the City Council to initiate an
independent investigation by either Federal Authorities or an independent counsel, like Mr. Bennett, to look into the depth and breadth of the corruption at Child and Family Services Agency (CFSA).
It has been almost a year since I last came before you highlighting the case of
how CFSA failed a now six-year- old child living in Ward 2. It is my opinion that by any
reasonable standard, CFSA failed to properly investigate complaints filed by mandated reporters in that case. In this case, CFSA went out of its way to avoid finding abuse and neglect.
My experience supports many of the allegations found in the December 6, 2008
letter of the “Concerned Social Workers.” That insightful letter was sent to the
Washington Post, Chairman Wells, and Federal Judge Hogan. It spoke of unethical CFSA practices in closing cases, including cases being closed by administrators and lawyers at CFSA.
For the suffering little girl mentioned, her situation appears to me to have become worse due to CFSA’s failures. Those failures have left her in unnecessary danger with severe chronic neutropenia of undiagnosed cause -- a life-threatening very rare blood disease, which evidence strongly suggests is induced by drugs commonly used for covering up abuse. CFSA ignored these and other facts.
When I came before you a year ago, I sincerely believed that the irregularities we
had witnessed were simply caused by an agency that did not have the will or skill to do
its’ job. As the irregularities have become greater and certain CFSA employee
actions more antithetical to the agency’s purpose..... including attempts to prevent
other institutions from finding abuse and providing help for this child –- an innocent
explanation no longer seems plausible to me.
Disturbing facts have come to light that give answers, I believe, as to why high
ranking CFSA employees have abdicated their responsibilities, interfered with the
CFSA investigations, and, also in my opinion, have acted beholden and protective of
abusers and their attorneys.
Today, we must take a stand to save this child, and others like her, by giving them
immediate relief and safety. Organizations from around the world and the US,
including members of Congress, have been made aware and are looking for this
situation to be corrected.

Will Washington DC once again make the headlines and
have to explain why another child’s life was lost while this agency looked the other way?
The explanation for this corruption that I refer to is both disturbing and appalling.
One very egregious example involves one key high-ranking official of CFSA. Not a
widely known fact, it involves a high ranking CFA official who was arrested for a
sexual offense, and went into a sex offender diversion program that included: one year supervised probation, and psychological evaluation.
Why would a person with such a background be allowed to work in CFSA, or any
other agency involved with the welfare of children?
How was the District made aware of this person’s background, and what did it do
about it? What is the magnitude of the impact this little known fact can have on such a
person’s independence to advocate for abused children, rather than for suspected abusers -- who would be inclined to use this information to pressure such a CFSA official to prematurely close and improperly dismiss abuse cases?
Only through an independent investigation can the depth and breadth of this
problem be uncovered, and the damage it has caused to the children of Washington DC
corrected. In the interim, we ask that the DC Counsel order the immediate reopening, investigation, and corrective action in all cases, including the case of the six year old neutropenic little girl, that were wrongfully interfered with by those corrupted employees.
Background
Based on my understanding, the six year old child lives isolated in a small onebedroom
apartment, in a windowless bedroom, sleeps in a queen sized bed that takes up most of that windowless room. She has – on a number of occasions – told medical and psychological personnel and forensic interviewers that her father sleeps in her bed, the “poppo gets harder and harder,” and that her father does “bad touch” while pointing to her inner thighs. Consistent with medical harm, she now has a very rare blood disorder, that only appeared soon as she disclosed that her “papa gives me green medicine to make me sick. But don’t tell him I told you.” Dr. Joy Silberg, a mandated reporter who is an internationally recognized specialist in abused children, submitted a written complaint to CFSA. However, even after CFSA social workers claim to have visited this one bedroom apartment that is used as an a multibedroom living quarters, and examined these documented facts, that was not enough for CFSA to investigate further. The six year old child suffers from a very rare blood disease called severe chronic neutropenia that can be induced with drugs, – a condition similar to AIDS –that leaves
the body with little defense to fatal infection. With this disease, one day the patient can look fine, ....the next day catch an infection,.... and the next day die from the infection that your and my body can easily tolerate, but hers cannot. However, when the father failed to take the child to a hematologist/oncologist on his own for months – it hardly raised an eyebrow at CFSA. This is despite the fact that at least two medical experts had expressed concern that the suspected abuser failed to take such basic diagnostic actions. One of the world’s leading pediatric severe chronic neutropenia expert researcher and physician who is the Co-Director of the Severe Chronic Neutropenia International Registry, has reviewed the same records as CFSA, and concluded that the child’s severe neutropenia is likely due to toxins/drugs – including the type that a neurologist, such as the father, would have access to. Again, this CFSA did little for the
child, and failed to follow its own protocol for independent evaluations.
Based on the records, a sexual abuse investigation at Children’s National Medical Center (CNMC) appears to me to have been made purposely superficial and misdirected by the unexplainable actions of CFSA. The CFSA social worker involved -- who had already preliminarily concluded that there was no abuse – allowed the suspected father to accompany the little girl to CNMC. Once there, the CFSA social worker appears to have instructed CNMC not to interview the child, misinformed them by telling them that the mother was the source of the reports about abuse, and failed to mention that the written complaints were submitted to CFSA by multiple mandated reporters. As any person familiar with sexual abuse investigations knows, an interview can only be successfully done without the abuser present and such an interview is critically important to such an investigation. To make matters worse, CFSA used that superficial sexual abuse investigation as a fraudulent basis for claiming in other venues
that the medical neglect concerns involving the severe neutropenia were “unfounded.”
In addition, even without speaking to the child, the records show that CNMC diagnosed her with “post traumatic stress disorder,” and recommended regular therapy for the child but there is no record of any follow-up by the father or CFSA to assure that therapy was provided. That alone should have been a basis for finding neglect.
After that very brief irregular investigation was quickly opened and closed as “unfounded,” a high level executive of CFSA demanded medical records from Georgetown University Hospital – where the CFSA request made the material isrepresentation that the child was a “District of Columbia committed ward.” When questioned, Dr. Roque Gerald wrote a reply claiming that the high level CFSA executive was simply the using a generic form – but he did not explain why a generic form having such a material misrepresentation was used. No explanation was given why additional inquiry was being made by CFSA after it supposedly had closed the earlier investigation as unfounded. Were those earlier cases really closed? Where they really found to be unfounded? Was CFSA having second thoughts? Did CFSA know that the records it received from Georgetown were incomplete because they did not include all test results? How many other instances has CFSA used this generic form to obtain information knowing that it contained misrepresentations of the status of the child.
When asked for a report on the investigations, one CFSA official told us in writing that we would get a summary report. Later, when asked again, we were told that such reports are not provided for “unfounded cases.” However, the suspected abuser father received not just one, but three different reports – including one faxed to him at 6:30pm in the evening from CFSA’s offices. Those reports were never forwarded to the mother.
in what appears to me to be a wholesale cover-up, CFSA refused to provide copies of any documents in response to a FOIA request, including even documents it had filed publicly, documents it had previously exchanged with the abusing Father and his counsel, and as well as those it had exchanged with the mother and her counsel.
No attempt was made to even provide a Vaughn index, nor redacted versions of the documents – even though required by law for documents even when they contain FOIA exempt information. Furthermore, given that CFSA’s FOIA statistics from the City’s Secretaries office indicate that a complete denial of a FOIA request by CFSA is rare [none out of 19 FOIA requests in FY2009 were denied in whole]1 – it only adds to further evidence that CFSA is attempting to cover up the corruption in its ranks.

WASHINGTON -- The House voted unanimously Thursday to impeach a U.S. district judge from Louisiana, who lawmakers said avoided likely criminal charges related to alleged payoffs in part because the statute of limitations expired.

A Federal Judge who came up from the lower courts, and who apparently had a history of corruption. As usual, the statement is made that a small minority give all the overwhelming number of honest judges a bad name. While I am sure that is probably true, just think of the tremendous amount of damage this one judge has done to individuals who believed the judiciary is 100% honest.

My beautiful child was taken from me when she was a year and a half.

I want as many people around to know that economics is the factor that determines who gains custody of children.

If you do not have the money to hire competent lawyers, you will lose.

I told Esther Wiggins Lyles that my daughters father was threatening to send her to France, and erase me from my daughters life. I told her in testimony and in writting. She did not believe me.In 2000 my daughter was shipped off to france and abandonned by her father for over five years.

He sent Judge Lyles fraudulent letters maintaining an elaborate lie, that our daughter was living with him in the United States.

He did this to continue collecting child support and also because he knows Lyles is stupid enough to automatically believe everything he says.

Lyles is very proud, and will never admit making a mistakeBecause of her pride, this man will go unpunished.

The community has the right to know what She did to my daughter and what this has done to my life.

I live with a deep pain every day, I think of my daughter day and night, and the worst part is that I know that I can do nothing for this poor little girl

Any human of morality and conscience will agree that Esther Wiggins Lyles is harmful to the State of Virginia......

When evidence emerges that a Judge is abusing his/her judicial office for his own advantage, the integrity of the judicial system becomes compromised, and the House of Representatives has the duty to investigate the matter and take the appropriate actions to end the abuse and restore confidence in the judicial system.

It is not a satisfying task to impeach a judge, yet when a judge so clearly abuses his office, as in the case of Judge Bruce D. White of Fairfax County it becomes necessary to take the appropriate action in order to restore the confidence of the American people in the judicial system. The Constitution gives the House of Representatives the power and responsibility to impeach federal judges and it is a power that Congress utilizes only in cases involving very serious allegations of misconduct. The Task Force on Judicial Impeachment, the House Judiciary Committee and the full House of Representatives should work together in a bipartisan fashion to ensure that rapid action is taken to Eradicate corruption in our judicial system.

Plants, Rechtzigel, and McArthur also face multiple counts of perjury, each of which carry a maximum penalty of life in prison.

in regards of Judge Leslie Alden .....My Lawyer put my Ex husband on the stand and asked for his Driver’s License in the Judge Alden's Court room. Under oath of course, he presented a fake Washington DC, Driver’s License!!!!!!!!!

The fake Driver’s License had the Holliday Inn Hotel address in Washington DC with the room number!!!!!!!! The forged Drivers license was too evident, like printing $3.00 bill and try to shop with it.

The man testified that yes I’ve been living in Fairfax County for the 5 years (The address that was given by him to the Court & Dept. of Child Support for 5 years), but because I’m traveling for business to Washington DC , I often stay in this Holiday inn Hotel ....Hummm usually staying in the same room, so I got the Driver’s License with the Hotel address!!!!!!!

First of all from his apartment in Fairfax county to Washington DC is only 30 minutes drive, second of all Obtaining Driver’s License with the Hotel address?????

Erratic and Legally Challenged
Although Judge Alden seems generally polite and respectful (better than other judges), her understanding of the law and concern for accurately following the law is very weak.

I have seen her invent non-existent rules and conditions concerning quantum meruit (a type of contract case) so as to screw a guy out of $50,000. Even though the law was clear, she was utterly confused about what the legal requirements of quantum meruit are, and announced an opinion that based her decision on non-existent requirements. It was clear to me that she really did not care all that much about what the law says, but was more interested in her own opinions of what the law should say. That is, she paid no respect to the precedents, but just made up "Alden's Law" to suit her own fancy.

Fairfax delegation selects judges

The Fairfax delegation to the General Assembly has selected General District Judge Lorraine Nordlund and substitute judges Michael F. Devine and Brett A. Kassabian to fill pending vacancies on the county circuit court.

Del. David Albo, the Republican who chairs the House Courts of Justice Committee, said members of the delegation interviewed candidates for the positions last night.

Under the delegation’s procedures each delegate and senator gets a vote, and the candidate with a majority of those votes gets the nod.
All members of the delegation accept the vote of the majority and back the candidates in the General Assembly, where support by the local delegation is tantamount to election.
Nordlund was elected to the general district bench in 1996. She is a former prosecutor in the county, and her practice before joining the bench included domestic relations and criminal and employment matters.
Devine is a partner in the firm of Devine, Connell & Sheldon PLC and has tried more than 100 jury cases since he began practicing in the county in 1991.
Kassabian is a principal in Kassabian & Kassabian PLC and started his career as a Fairfax prosecutor in 1985. He has a general practice that includes criminal defense and personal injury work.The Fairfax Bar Association’s judicial nominating committee highly recommended Devine and Kassabian and found Nordlund to be qualified.
Kassabian and Devine were two of the three most popular candidates in an electronic vote on the candidates by 714 of the association’s 1,715 members. The second most popular candidate, General District Judge Michael J. Cassidy, was highly recommended by the nominating committee.
The votes for each of the candidates are here. Members have a choice of voting “endorse,” “not endorse” or “no opinion” if they do not know enough about the candidate to vote one way or the other.
The vacancies were created by the retirements of Judges Gaylord L. Finch Jr., Stanley P. Klein and Michael P. McWeeny.
